She has a point. The manhole should not have been left unattended without some sort of barricade, warning sign, or cones. Depending on the location of the manhole, a blind person could just as easily have fallen in.

Stupidity should not win court cases.

The only thing that I would grant them is payment of medical costs. Period. I can already tell that they are going to try to take the city for all they can. "Nightmares about falling" is code word for "Mental anguish".

I vote that stupidity should be a crime and the city should sue her for being stupid enough to walk into an open hole in the ground.

This reminds me of a girl my mom saw in the hospital she works at - a 16 year old girl decided she wanted to send a text message while walking across an interstate. Needless to say, since she wasn't paying attention, she stepped out in front of a car, got nailed at 60+ mph (100+ kph) and died in the hospital.

Cell phones should just be banned until 18+, at least over here in America where we're too stupid to use them properly.

I don't remember that, but Scaffolding poles are required to be padded / protected at pedestrian level in the UK, unless a further method of pedestrian protection can be implemented.

Yes, common sense should have prevailed...but the world does seem to be getting thicker, on the whole. It's unfortunate that this is probably the catalyst for the barrage of health and safety implemented by the men in goggles that we now must all adhere by.

Both parties were in the wrong: The workmen for not either placing warnings around the manhole, or replacing the cover properly, and the "victim" for not looking where she was going. The former could be human error, pure and simple. The latter was just carelessness.

Actually, she should have been warned by the city workers, its pretty cut and dry. The workers should have put a sigh or something to warn others of the obvious danger. But she wasn't been stupid but being careless, but it really doesn't matter in the end because the point is, the workers were negligent about a work and safety standard that apply to road work.

Any ways about the article; I think they should have put cones there in warning for people, but the girl's family shouldn't sue because of her daughter's stupidity of not knowing where she was walking.

I was just thinking, why didn't she smell an open sewer full of crap? If there is an open sewer so full of crap it needs to be flushed out, you'd think it'd make some sort of smell.

Anyways, in real life you aren't going to get warning signs to danger. I hope she gets better, but that girl and her mom also need something called being aware and responsibility. If you are dumb enough to walk into an open manhole full of crap because you are texting, maybe you shouldn't be texting so much you that you aren't paying attention to your surroundings. If that girl died instead of only getting hurt, I'd say she would have been Darwin Award of the Year candidate.

She fell in the hole because of her own carelessness, so it isn't the city's job to pay her back and those two workers definitely shouldn't be fired.

BTW thanks for the comment on the title... it took me awhile though to spell that poorly.
